En signe de solidarit\u00e9, Mailfence s&rsquo;est joint aux organisations de d\u00e9fense de la vie priv\u00e9e signataires pour envoyer la lettre suivante aux r\u00e9gulateurs europ\u00e9ens et am\u00e9ricains le 7 juillet 2021, afin de les encourager \u00e0 prendre des mesures lors des sessions l\u00e9gislatives et \u00e0 l&rsquo;occasion de tout d\u00e9bat sur la vie priv\u00e9e portant sur la publicit\u00e9 bas\u00e9e sur la surveillance.<\/p>\n\n\n\n<p><strong>La publicit\u00e9 bas\u00e9e sur la surveillance est omnipr\u00e9sente sur Internet aujourd&rsquo;hui, et cela soul\u00e8ve un certain nombre de questions tr\u00e8s probl\u00e9matiques pour les consommateurs et <a href=\"https:\/\/blog.mailfence.com\/fr\/proteger-les-donnees-espionnage-entreprises\/\">les entreprises<\/a>.<\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/www.forbrukerradet.no\/side\/new-report-details-threats-to-consumers-from-surveillance-based-advertising\/\">Le 23 juin, une large coalition<\/a> d&rsquo;organisations de d\u00e9fense des droits des consommateurs, de groupes de d\u00e9fense des droits civils, d&rsquo;ONG, ainsi que d&rsquo;universitaires, de chercheurs, d&rsquo;experts et de passionn\u00e9s de la protection de la vie priv\u00e9e &#8211; tous des personnes concern\u00e9es &#8211; a appel\u00e9 les r\u00e9gulateurs \u00e0 mettre fin aux pratiques invasives et nuisibles pour la vie priv\u00e9e li\u00e9es \u00e0 la publicit\u00e9 bas\u00e9e sur la surveillance.<\/p>\n\n\n\n<p>Au sein de l&rsquo;UE, ils ont exhort\u00e9 les r\u00e9gulateurs \u00e0 envisager d&rsquo;interdire la publicit\u00e9 bas\u00e9e sur la surveillance dans le cadre de la loi sur les services num\u00e9riques (Digital Services Act). Aux \u00c9tats-Unis, ils ont exhort\u00e9 les l\u00e9gislateurs \u00e0 adopter une l\u00e9gislation compl\u00e8te sur la protection de la vie priv\u00e9e.<\/p>\n\n\n\n<p><strong>Nous sommes un groupe d&rsquo;entreprises qui vous \u00e9crit aujourd&rsquo;hui pour vous t\u00e9moigner notre soutien \u00e0 cette initiative. Nous repr\u00e9sentons des petites, moyennes et grandes entreprises qui croient toutes &#8211; et d\u00e9montrent quotidiennement &#8211; qu&rsquo;il est possible de g\u00e9rer des entreprises rentables sans exploiter la vie priv\u00e9e des individus.<\/strong><\/p>\n\n\n\n<p>Outre les probl\u00e8mes \u00e9vidents de protection de la vie priv\u00e9e caus\u00e9s par la publicit\u00e9 bas\u00e9e sur la surveillance, celle-ci est \u00e9galement pr\u00e9judiciable \u00e0 l&rsquo;environnement commercial.<\/p>\n\n\n\n<p>Dans le mod\u00e8le de publicit\u00e9 bas\u00e9e sur la surveillance, une minorit\u00e9 d&rsquo;acteurs obtiennent des avantages concurrentiels en collectant des donn\u00e9es sur l&rsquo;ensemble des sites web et des services, et les acteurs dominants des plateformes peuvent abuser de leur position en donnant la pr\u00e9f\u00e9rence \u00e0 leurs propres services.<\/p>\n\n\n\n<p>Ces pratiques portent gravement atteinte \u00e0 la concurrence et privent les cr\u00e9ateurs de contenu de leurs revenus. Les comportements et effets anticoncurrentiels servent \u00e0 consolider les positions des acteurs dominants, tandis que les les canaux de diffusion complexes et les technologies inefficaces entra\u00eenent un manque \u00e0 gagner pour les annonceurs et les \u00e9diteurs.<\/p>\n\n\n\n<p>Il est \u00e9galement difficile pour les consommateurs de faire la distinction entre les \u00ab\u00a0bons\u00a0\u00bb et les \u00ab\u00a0mauvais\u00a0\u00bb acteurs de la sph\u00e8re num\u00e9rique, ce qui signifie que les acteurs l\u00e9gitimes, parmi lesquels de nombreuses petites et moyennes entreprises, sont directement touch\u00e9s par les actions d&rsquo;entreprises sans scrupules.<\/p>\n\n\n\n<p><strong>Cela nuit aux consommateurs et aux entreprises, et peut saper les fondements de la d\u00e9mocratie.<\/strong><\/p>\n\n\n\n<p>M\u00eame si nous reconnaissons que la publicit\u00e9 est une source importante de revenus pour les cr\u00e9ateurs de contenu et les \u00e9diteurs en ligne, cela ne justifie pas les syst\u00e8mes de surveillance commerciale massive mis en place pour tenter de \u00ab\u00a0montrer la bonne publicit\u00e9 aux bonnes personnes\u00a0\u00bb.<\/p>\n\n\n\n<p>D&rsquo;autres formes de technologies publicitaires existent, qui ne d\u00e9pendent pas de l&rsquo;espionnage des consommateurs, et des mod\u00e8les alternatifs peuvent \u00eatre mis en \u0153uvre sans affecter significativement les revenus.
